Terms of Service

These Terms of Service ("Terms") govern your access to and use of the onboarding software development kit, dashboard, APIs, and related services (collectively, the "Service").
By accessing or using the Service, you agree to be bound by these Terms.
1. The Service
The Service provides tools for configuring, managing, and analyzing onboarding flows within mobile applications, including the ability to remotely configure pre-bundled onboarding screens.
The Service is provided as a developer tool and does not itself constitute an end-user application.
2. Eligibility
You may use the Service only if:
- you are legally capable of entering into a binding contract, and
- you are using the Service on behalf of yourself or a legal entity you are authorized to represent.
If you are using the Service on behalf of an entity, you represent and warrant that you have the authority to bind that entity to these Terms.
3. Account Registration
To use certain features of the Service, you may be required to create an account.
You are responsible for:
- maintaining the confidentiality of your account credentials
- all activities that occur under your account
You must notify us promptly of any unauthorized use of your account.
4. License and Permitted Use
Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to use the Service for the purpose of integrating onboarding functionality into your applications.
You may:
- integrate the SDK into your applications
- configure onboarding flows using the dashboard
- use analytics and experimentation features provided by the Service
You may not:
- reverse engineer, decompile, or attempt to extract source code from the Service
- use the Service for unlawful or abusive purposes
- resell, sublicense, or provide the Service to third parties except as expressly permitted
5. App Store and Platform Compliance
You acknowledge and agree that:
- You are solely responsible for ensuring that your applications comply with all applicable platform rules, including app store guidelines, developer agreements, and applicable laws.
- Platform owners (such as app store operators) review and approve applications, not developer tools.
- Use of the Service does not guarantee approval or continued availability of your application on any platform.
We may provide documentation or recommendations regarding compliant usage, but such guidance is informational only and does not constitute legal advice or a guarantee of compliance.
6. Remote Configuration and Content Responsibility
The Service allows remote configuration of onboarding flows, including content, screen order, design settings, and experimentation.
You are solely responsible for:
- all content, copy, texts, and configurations delivered through the Service
- ensuring that no unreviewed or non-compliant functionality is introduced through remote configuration
- ensuring that onboarding flows do not mislead users or violate platform policies
- testing any modifications to onboarding flows on physical devices and in staging environments before deploying them to your production application; you assume full responsibility for any errors, crashes, or user experience issues in your production application resulting from remote configurations, including those not adequately tested prior to deployment.
We do not review, approve, or monitor your onboarding content for compliance.
7. Prohibited Use
You may not use the Service to:
- introduce executable code or native functionality not included in your application binary
- circumvent platform review processes
- misrepresent app behavior to users or platform reviewers
- collect data in violation of applicable privacy or data protection laws
8. Data and Privacy
You retain ownership of all data you submit to or generate through the Service.
You are responsible for:
- providing legally required disclosures to your end users
- obtaining all necessary consents
- complying with applicable data protection and privacy laws
Our processing of personal data is governed by our Privacy Policy.
9. Fees and Payment
Certain features of the Service may require payment.
Fees, billing cycles, and payment terms will be disclosed prior to purchase.
All fees are non-refundable unless otherwise stated.
We reserve the right to change pricing with reasonable notice.
10. Availability and Modifications
We may modify, suspend, or discontinue the Service (or any part of it) at any time.
We do not guarantee uninterrupted or error-free operation of the Service.
11. Termination
You may terminate your account at any time.
We may suspend or terminate your access to the Service if you:
- violate these Terms
- use the Service in a manner that exposes us to legal or reputational risk
Upon termination, your license to use the Service will immediately cease.
12. Disclaimer of Warranties
The Service is provided on an "AS IS" and "AS AVAILABLE" basis.
To the maximum extent permitted by law, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement.
We do not warrant that the Service will meet your requirements or that your applications will be approved by any platform.
13. Limitation of Liability
To the maximum extent permitted by law:
- We shall not be liable for any indirect, incidental, special, consequential, or punitive damages.
- Our total liability arising out of or related to the Service shall not exceed the amount paid by you for the Service in the twelve (12) months preceding the claim.
14. Indemnification
You agree to indemnify and hold us harmless from any claims, damages, liabilities, and expenses arising out of:
- your use of the Service
- your applications or onboarding content
- your violation of applicable laws or platform policies
15. Governing Law
These Terms shall be governed by and construed in accordance with the laws of Germany, without regard to conflict of law principles.
16. Changes to These Terms
We may update these Terms from time to time.
Continued use of the Service after changes become effective constitutes acceptance of the updated Terms.
